Fleeing A Law Enforcement Officer City of Fond du Lac Municipal Court Dismissed

Unusual fact pattern to this case. Client's car was taken by a relative's boyfriend from its parking spot outside client's apartment. Local police attempted to stop the relative's boyfriend while driving the client's car. The boyfriend took off and got away but the police were able to take down the vehicle's license plate number.

Atty. Skarie is contacted by the client because the police have accused him of fleeing from police in the vehicle. Client is obviously upset that he has been accused of something he did not do.

After consulting the statutes, Atty. Skarie was able to determine that law enforcement failed to follow statutory guidelines in serving the citations on the client. The prosecutor was left with no choice but to dismiss all counts. Very stressful for the client but in the end a positive outcome.
