OWI 1st Offense Milwaukee County Circuit Court Dismissed

Client was charged with first offense drunk driving. Client provided law enforcement with a .09 breath test. Client is a family man with no prior record. Attorney Skarie analyzed the case and determined there was a 4th Amendment suppression issue regarding an unlawful arrest. Dan filed the motion and the Court set a date to hear testimony.

Twice, the prosecution's key witness, the Milwaukee County Sheriff's deputy who arrested the client failed to appear at the hearing. Without their key witness, the prosecution could not proceed and the case was dismissed.
